Moore v. Harper

Arguments begin in Moore v. Harper on December 7 (tomorrow), and the Court’s ruling could dramatically change election law as we know it. You can listen to the court proceedings tomorrow at: https://www.supremecourt.gov/oral_arguments/live.aspx

The case concerns an interpretation of the U.S. Constitution known as the independent state legislature theory, which would render state courts and state constitutions powerless when it comes to federal elections. Adopting this theory could mean that voters across the country would have no judicial power to fight partisan gerrymandering.

On November 29, LWVNYS organized a program on this critical court case. Speakers for the program included:

Richard Rifkin, Legal Director of the Government Law Center at Albany Law School

Caren E. Short, Director of Legal and Research for the League of Women Voters of the United States

Michelle Kanter Cohen, Policy Director and Senior Counsel at the Fair Elections Center
